Wrongful Death Claims

ebraska law permits recovery when the death of a person is caused by the wrongful act, neglect, or default of another. This wrongful act can be anything from an automobile accident to death caused by an unsafe product. A wrongful death action in Nebraska is governed by statute.

Factors that may be considered in determining the damages due to the surviving spouse or next-of-kin in a wrongful death action include:

  • Financial support;
  • Services, comfort or companionship that the decedent provided before death and the prospect that there would have been changes in the future;
  • Physical and mental health of the decedent had he or she not suffered the injuries causing his or her death; and
  • Decedent’s life expectancy prior to suffering the injuries that caused his or her death and the life expectancy of the spouse or next-of-kin.
